This Privacy Policy (“Policy”) presents our privacy practices, so you understand when and how personal information is collected, used, disclosed, and protected.

You must be at least age 13 to provide us information, and by doing so, you warrant that you are at least age 13.

This Policy applies in connection with information collected for Raging Waters Sydney Pty Ltd, including its parent entity Festival Fun Parks, LLC, a Delaware, U.S.A. limited liability company doing business as Palace Entertainment, and any related, affiliates or associated parks (each a “Park”) identified through www.palaceentertainment.com/pick-a-park. By providing us any personal information, and to the extent you do not opt-out of digital marketing and communications in accordance with the instructions stated below, you hereby consent to this Policy and any updates to it as will be posted on this webpage from time to time.

1. YOUR INFORMATION AND HOW WE USE IT

Personally Identifiable Information (“PII”) may be collected when you choose to participate in a newsletter, or in any promotional, e-commerce, interactive activities offered, or purchases, as well as by your visit to one of our websites. PII collected may include:

personal information (such as your name, address, e-mail address, and location); and,
aggregate information (such as the number of users accessing a website on a daily basis).

We may collect, aggregate and use PII across the websites and Parks.

1.1 INFORMATION WE COLLECT

(a) Automatically Collected Information

We automatically receive certain types of information whenever you interact with one of our websites. For example, when you visit one of our websites, our systems automatically collect your IP address and the type of browser you use. Information may be automatically collected through the use of “cookies” which are discussed further below. We may also collect information about your browsing behaviour, such as IP address information, entry and exit points for a website, page views, and impressions. This information may be used to help analyze website traffic and improve our services.

(b) Cookies

To make our websites work properly, we sometimes place small data files called cookies on your device. Cookies are small text files that a website saves to your computer or mobile device when you visit a website. They enable the website to remember your actions and preferences over a period of time.

In general, we use cookies to collect information so that we can determine how to improve our websites by seeing which areas, features and products are most popular, to personalize the websites and improve website experience. Most browsers automatically accept cookies as the default setting. Web beacons may send this information directly to us, or to third parties we have approved to receive the information.

(d) Online Advertising and Conversion Tracking

We collect information about your activity, or activity on any devices with which you may be associated that access our websites, using cookie and web beacon technology described above. Information collected may include frequency of site visits, pages viewed, browser type, time and date of web visits, etc. We allow authorized media vendors and other third parties to serve online advertising and collect certain information when you visit our websites. This information is used to decide which ads you see based on your activity on our websites, but does not identify you personally. In addition, purchase behaviour and conversions are tracked and analyzed to decide what advertising is most effective. (e) Do Not Track Requests

Our websites do not respond to browser-based, Do Not Track requests or signals. However, we do not permit third parties to collect a consumer’s PII while a consumer is on one of our websites.

1.2 USE OF PERSONALLY IDENTIFIABLE INFORMATION

(a) Internal Use

In general, we use PII 1) internally to serve our users or customers, and 2) to enhance and extend our customer and user relationships so our users or customers may take maximum advantage of our items, merchandise, and services. For example, by understanding how you use our websites from your computer or mobile device, we are able to customize and personalize your experience. More specifically, we use PII to provide services or to anticipate and resolve problems with our websites, or to respond to customer support inquiries, and to create and inform you of our new products or services that may better meet your needs.

We may use PII (and aggregate information) for our own internal statistical, design, or operational purposes, such as to estimate our audience size or to measure aggregate traffic patterns as well as to understand demographic, customer interest, and other trends among our users. We may outsource these tasks to service providers; however, they may not use or disclose your PII for any other purposes.

When you purchase an item, merchandise, or a service, PII (which you voluntarily provide) is collected. It may include:

first and last names;
birthdates and/or birthdays;
billing address;
email address;
phone number;
credit card number; and,
information related to any accommodation you request.

This information is then used to:

complete your purchases;
respond to your inquiries;
subject to your prior consent, notify you regarding promotions or other information about us, i.e. to inform you about news, send you special offers, etc.;
inform participants in a competition of prizes won; or,
if you have made a booking, to send you information on products or services as a function of those previously purchased.

(b) Disclosure

(i) For Commercial Purposes

We use PII to further our business. To do so, we may share it with our staff and service providers.

We do not otherwise share PII for commercial purposes, unless you have consented, for example at the time of collection or registration.

When we share PII for commercial purposes, we do so only if the recipient undertakes to exercise care to safeguard the PII equivalent to that which we exercise.

(ii) As Required by Law; For Protection

We may disclose any PII or aggregate information if:

required to do so by law, including compliance with legal process served on us, or,
such action is necessary or desirable to:
- protect or defend our legal rights and property, or those of our users, or,
- protect health and safety of our users, staff, service providers, or the general public.

(iii) Business Transfers

Information about our users, customers, websites, and Parks is one of our most important business assets. Such information, including PII, may be disclosed in furtherance of any merger or acquisition, creation of a separate business, or the sale or pledge of our assets as well as in the event of an insolvency, bankruptcy or receivership in which PII may be transferred as a business asset.

We will retain PII in private databases for the period that we find necessary to fulfil the purposes outlined in this Policy, unless we believe a longer retention period is required or permitted by law. You may request that we destroy, transfer, or update your PII in our possession, and we will take commercially reasonable steps to honour your requests. PII and aggregate information shared with our service providers may be stored on their systems. When we in our discretion deem retention of PII is no longer needed, we may shred, erase, destroy, or otherwise modify it, in whole or in part.

(d) Security of Personally Identifiable Information

The secure storage of PII is of great concern to us. We exercise care in transmitting your information. Only those individuals who need access to your information in order to do their jobs are allowed access. Any of our staff or vendors who violate our privacy and/or security policies, is (if a vendor) subject to legal action and/or termination of contract, or (if a staff member), subject to disciplinary action, including possible termination and civil and/or criminal prosecution.

(e) Third Party Websites

We may provide links to third party websites from our websites as a service to our users. We are not responsible for the content or information collection practices of those websites. Such websites' privacy policies will differ from ours. Therefore, we encourage you to review and understand their privacy practices before providing them with information. We have no control over the security of other websites on the Internet that you might visit, interact with, or from which you buy products or services.

2.1 CONTROLS AND CHOICES

We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. These controls and choices include:

You may change your choices for subscriptions, newsletters and alerts.
You may correct, update and delete your registration account.
You may update your preferences as to whether or not you wish to receive offers and promotions from us for our products and services, or products and services that we think may be of interest to you.

You may request access to PII we hold about you and that we amend or delete it

2.2 YOUR PRIVACY RIGHTS

If you have provided PII to obtain products or services for personal, family or household use, you may request from us, once a calendar year, information about your PII that we shared, if any, with third-parties and businesses for their own direct marketing uses. Such information would be the categories of relevant PII and the names and addresses of those businesses with which we shared such PII for the immediately prior calendar year, e.g., a request made in 2017 will receive information regarding 2016 sharing activities. If you wish to obtain this information, you may e-mail PrivacyPolicy@palaceentertainment.com with “Request for Privacy Information” in the subject line and in the body of your message. We will provide the requested information to you by reply to the e-mail address from which you sent the request. Not all information sharing is covered by this requirement, and only information on covered sharing will be included in our response. If you prefer to receive such information via regular first-class mail, please include such request in your email. We will not accept requests via telephone or facsimile or in-person, and we are not responsible for notices that are improperly labeled or delivered, or that do not have the complete information as here specified.

2.3 UPDATING THIS POLICY

We may revise and update this Policy:

if our practices change,
as technology changes, or,
as we add new services or change existing ones.

Updates to this Policy will be posted on this webpage (www.palaceentertainment.com/privacy-policy), and you agree that the posting of each update as such is sufficient notification to inform you of all changes included in the applicable update.

We will use information in accordance with the most current version of this Policy.

You are encouraged to print or download a copy of this document for your records.

3. CHILDREN'S PRIVACY POLICY

Our websites are intended for use by individuals at least age 13. We wish NOT to collect PII from children under age 13. On occasion, we may specifically instruct children not to submit such information. If a child under age 13 has provided us an e-mail address, the child’s parent or legal guardian may remove the child from our e-mail lists by clicking here: https://palace.secure.force.com/optout. Additionally, to request deletion of your child’s PII from our records, contact PrivacyPolicy@palaceentertainment.com. We will use commercially reasonable efforts to delete such information from our existing files.
